Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the Ascendant Automation website at ascendantautomation.com (the “Site”) and the marketing-automation services provided by Ascendant Automation (“Ascendant,” “we,” “us,” or “our”). By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services. Our privacy practices are described in our Privacy Policy.
Our Services
Ascendant Automation builds automated customer-acquisition systems for local service businesses, including lead capture, automated follow-up, appointment booking, and advertising-channel analysis. We do not guarantee any specific number of leads, appointments, customers, revenue, or advertising results. Outcomes depend on many factors, including your industry, market, advertising spend, and campaign performance. Advertising spend is paid separately by the client and is not included in any service fee.
Eligibility
You must be at least 18 years old and authorized to act on behalf of a business to use our services. By submitting a form or agreeing to these Terms, you represent that you meet these requirements.
Accounts & Forms
When you submit information through a form on this Site, you agree to provide accurate, current, and complete information and to update it if any details change. We are not responsible for errors or delays caused by inaccurate or incomplete information you provide.
SMS / Text Messaging Terms
The SMS program is operated by Ascendant Automation. By providing your mobile phone number and opting in to receive text messages, you consent to receive SMS messages from Ascendant Automation. The following terms apply to our SMS program:
- Program operator. The SMS program is operated by Ascendant Automation.
- What you may receive. Users who opt in may receive inquiry follow-ups, appointment confirmations and reminders, requested service information, customer-support communications, and promotional messages only where you have separately opted in to receive them.
- Message frequency. Message frequency varies and depends on your interactions with us, your service plan, and the follow-up workflows you or your business have enabled.
- Potential costs. Message and data rates may apply. Contact your mobile carrier for details about your messaging plan.
- Opt out. You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive no further SMS messages from our program (except where a confirmation of your opt-out is required).
- Help. Reply HELP at any time for assistance with our SMS program, or contact us at support@ascendantautomation.com.
- Consent is not a condition of purchase. Consent to receive SMS messages is not a condition of purchasing any goods or services from Ascendant Automation.
- Opt out at any time. Users may opt out at any time by replying STOP. Your privacy rights regarding SMS data are described in our Privacy Policy.
- Carrier liability. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by the user’s wireless service provider and network operator.
A2P 10DLC Compliance
Our SMS program complies with the A2P 10DLC (Application-to-Person 10-Digit Long Code) standards established by U.S. mobile carriers. We send messages only to numbers that have provided express consent, use approved message content, and operate within the carrier-defined throughput and volume limits. We do not send SMS marketing messages without prior express written consent, and we honor all opt-out requests promptly.
Fees & Payment
Service fees are described on the Site and in any applicable agreement you sign with us. Advertising spend is separate from our service fees and is the responsibility of the client. Unless otherwise stated, fees are billed in U.S. dollars and are non-refundable except where required by law. We may change our fees upon reasonable notice; any changes will not apply retroactively to fees already paid.
No Guaranteed Results
Ascendant Automation provides tools and services designed to help businesses capture, follow up with, and convert leads. We do not guarantee any specific outcome, including the number of leads, appointments, customers, revenue, or return on advertising spend. Any estimates or examples are illustrative only and do not represent a promise or guarantee of future results.
